PokerGO
Genesis NFT: Play with The Masters Giveaway
VOID WHERE PROHIBITED OR
RESTRICTED BY LAW. U.S. LAW GOVERNS. NO PURCHASE NECESSARY. A PURCHASE OR
PAYMENT OF ANY KIND WILL NOT INCREASE YOUR CHANCES OF WINNING.
As a condition of participating in
the Giveaway, you agree and acknowledge that social networking sites used to
promote the Giveaway (e.g., Facebook, Twitter, Snapchat, Discord) as well as
their owners, directors, officers, employees, contractors, agents,
representatives, parents, subsidiaries, attorneys, insurers, and associated
entities (collectively, the “Social Media Group”) are not sponsors of the
Giveaway, do not endorse or administer the Giveaway, and are not in any way
associated with the Giveaway. All questions regarding the Giveaway must be
directed to Sponsor, not the Social Media Group. You also agree that as a
condition of participating in the Giveaway, you shall release the Social Media
Group from any and all liability arising out of or
relating to your entry, creation of an entry or submission of an entry,
participation in the Giveaway, acceptance, use, or misuse of any prize, or the
broadcast, exploitation, or use of an entry.
The Giveaway is open only to citizens and permanent legal
residents of the United States of America and any other jurisdiction in which
the Giveaway is legal that are physically located and residing therein who (i) are at least eighteen (18) years of age or the age of
majority in their jurisdiction (whichever is higher) at the time of entry; (ii)
are not barred from participation in the Giveaway under
the laws of the jurisdiction of their residence including but not limited to
all federal, state, and local laws; and (iii) at all times abide by these
Official Rules. THE GIVEAWAY IS VOID WHERE PROHIBITED OR RESTRICTED BY LAW.
ALL APPLICABLE FEDERAL, STATE AND LOCAL LAWS APPLY.
NO PURCHASE OR PAYMENT OF ANY KIND IS
REQUIRED TO ENTER. A PURCHASE OR PAYMENT WILL NOT INCREASE YOUR CHANCES OF
WINNING.
During the Giveaway Period,
eligible individuals may submit entries into the Giveaway, as follows:
A) Holders of a PokerGO
Genesis NFT
1.
Holders
of a PokerGO Genesis NFT (“Genesis NFT(s)”) as
of 12:00:00 am PT on the date that is seven (7) days after the conclusion of
the applicable poker event are automatically entered into the Giveaway for such
drawing subject to the eligibility provisions of these Official Rules.
2. Genesis NFTs may be purchased from Sponsor or Sponsor’s agents at https://www.nftstadium.io/pokergo/.
3.
Genesis NFTs may also be purchased
from other Genesis NFT holders in the secondary market.
B) Alternative Method of
Entry (“AMOE”)
1.
Send
a postcard or letter to: PokerGO, 3993 Howard Hughes Pkwy., Suite 450, Las Vegas, Nevada 89169,
Attn: PokerGO
Genesis NFT: Play with The Masters Giveaway.
2. Include the following on the postcard or letter (please print legibly – illegible entries will be discarded):
a. Name, email address, and an Ethereum wallet address
(to receive the potential prize should you win);
b. A statement that you (i)
wish to enter the PokerGO Genesis NFT: Play
with The Masters Giveaway;
(ii) meet the eligibility requirements in the Official Rules; and (iii) agree
to all Official Rules; and
c. Your signature under the above statement and
information.
3.
Sponsor will assign you one random
pair of poker cards (i.e., one Texas holdem poker
hand) as your entry into the Giveaway which will include entry for all Giveaway
drawings occurring after its assignment and continuing through the remainder of
the Giveaway Period. Sponsor will email you information regarding the pair of
poker cards you were assigned.
4.
Only one AMOE entry is permitted
per person and holders of Genesis NFTs are not eligible for AMOE entries.
Entries generated by a script, computer programs,
macro-programmed, robotic or any other automated means are void and may be
disqualified at Sponsor’s sole discretion. Entries that are in excess of the
stated limits, incomplete, incorrect, illegible, corrupted, damaged, destroyed,
forged, false, lost, late, misdirected, deceptive, or are otherwise not in
compliance with the Official Rules are also void and may be disqualified from
the Giveaway at Sponsor’s sole discretion. Sponsor will not be responsible for
invalid submissions and has no obligation to advise an individual of such a
submission. If a problem occurs in the entry process, the entrant is solely
responsible for verifying that the entry process has been validly completed.
Entries received outside the Giveaway Period will not be included in the
Giveaway. Screen shots, printouts or other purported "proof" or
"evidence" of entry or winning, in lieu of Sponsor's validation
process, shall not be binding. Proof of sending (such as an automated receipt,
screen shots, etc.) does not constitute proof of actual receipt of an entry for
purposes of these Official Rules.
In the event of any dispute as to the identity of any entrant, Sponsor
may require proof of identity and residency such as a driver’s license,
passport, and/or utility bills, and proof of eligibility. Sponsor’s
determination of eligibility will be final.
Subject
to verification of eligibility and compliance with these Official Rules, the
following prize awards will be available to eligible entrants participating in
the Giveaway:

Each
drawing will consist of entrants whose Genesis NFT or assigned pair of cards
received under the AMOE match the hole cards played by the winner of the
subject poker event in the final hand of the event. All entrants
eligible for the drawing (i.e., those with a Genesis NFT or an assigned pair of
cards received under the AMOE that match the hole cards played by the winner of
the subject poker event in the final hand of the event) win the stated prize,
subject to eligibility requirements and compliance with these Official Rules. If there are
no Genesis NFT or assigned pair of poker cards received under the AMOE that
match the hole cards played by the winner of the subject poker event in the
final hand of the event, then no prizes will be awarded for that particular drawing.
Total ARV of all prizes
that could be awarded in the Giveaway is $500 USD. Prize will be awarded only
if the potential prize winner fully complies with these Official Rules. All
prize details are at the sole discretion of Sponsor and any depiction of the
prizes, in Giveaway materials or otherwise, is for illustrative purposes only. Prizes are non-transferable, non-exchangeable,
non-refundable, may not be redeemed for a cash alternative, and must be
accepted by the winner as awarded. In the event of non-compliance with these
Official Rules by a prize winner, that prize will be forfeited. A forfeited
prize may be awarded to an alternate winner, in Sponsor's sole discretion. If a
particular prize is unavailable for reasons outside of Sponsor’s reasonable
control (i.e., inability to secure a digital signature from a winner) Sponsor
shall have no responsibility or obligation to a prize winner or a potential
prize winner for such unavailable prize, and in such an event, such unavailable
prize will be removed from the Giveaway and Sponsor will replace such
unavailable prize with an alternative prize of equal or greater value
(including, but not limited to, a NFT having alternative characteristics, as
determined by Sponsor in its sole discretion).
All federal, state, and
local taxes, and all costs and expenses related to the acceptance and use of a
prize not specified herein, are the sole responsibility of the prize winner.
Prizes will be disbursed
automatically (i.e., via an “airdrop”) to the potential winner(s) within thirty
(30) days from the applicable drawing date to the Ethereum wallet linked to the
winning Genesis NFT and/or to the Ethereum wallet provided in a winning AMOE
entry.
In the event a potential winner is
disqualified for any reason, or the Ethereum wallet address provided in an AMOE
entry is incomplete or inaccurate, or if a prize is unclaimed or not accepted,
the prize will be forfeited. If
forfeited for any reason, the potential winner will not receive any other prize
substitution or compensation, and the prize will remain the property of Sponsor
and will not be awarded unless Sponsor, at its sole discretion, decides to award the forfeited
prize to an alternate potential winner.
Except where prohibited by law, by participating in this
Giveaway or accepting a prize, entrants grant Sponsor and its designees the
right to use and/or publish (as applicable) the entrant’s Ethereum wallet
address, full name, city and state of residence, photographs or other
likenesses, pictures, portraits, video, voice, testimonials, biographical
information (in whole or in part), and/or statements made by the entrant
regarding the Giveaway or Sponsor, worldwide and in perpetuity for any and all
purposes, including, but not limited to, advertising, trade and/or promotion on
behalf of Sponsor in any and all forms of media, now known or hereafter
devised, including, but not limited to, print, TV, radio, electronic, cable, or
World Wide Web, without further limitation, restriction, compensation, notice,
review, or approval.
ENTRANT FURTHER ACKNOWLEDGES THAT THEIR PERSONAL IDENTIFYING
INFORMATION MAY BE DISCLOSED TO THIRD PARTIES INCLUDING, WITHOUT LIMITATION,
PLACING THEIR NAME AND/OR ETHEREUM WALLET ADDRESS ON A WINNERS’ LIST.
Winning a prize is
contingent upon accepting these Official Rules and fulfilling all requirements
of these Official Rules. Sponsor reserves the right without liability to
disqualify any entrant or cancel, suspend, modify, and/or terminate the
Giveaway, or any part of it, for any reason, including, but not limited to,
insufficient entries in the Giveaway, postponement or cancellation of a
particular event, any occurrence of, or circumstances resulting in, no final
hand being played for a particular event, any printing, seeding, typographical,
technical errors, human or otherwise, suspected or actual evidence of
electronic or non-electronic tampering with any portion of the Giveaway, or if
computer virus, bugs, unauthorized intervention, fraud, or technical difficulties
or failures compromise or corrupt or affect the administration, integrity,
security, fairness, or proper conduct of the Giveaway or any other factor
beyond Sponsor’s reasonable control, as determined by Sponsor at its sole
discretion. In such event, Sponsor reserves the right but not the obligation to
award the prizes to the extent required by law for eligible entries submitted
up to the time of the impairment (and/or thereafter), or in such other manner
as deemed fair and appropriate by Sponsor at its sole discretion. Sponsor also
reserves the right to disqualify any individual it finds to be tampering or
interfering with the operation of the Giveaway or acting in violation of these
Official Rules or in an unsportsmanlike or disruptive manner.
ANY ATTEMPT BY ANY PERSON
TO DELIBERATELY UNDERMINE THE LEGITIMATE OPERATION OF THE GIVEAWAY MAY BE IN
VIOLATION OF CRIMINAL AND CIVIL LAWS AND SPONSOR RESERVES THE RIGHT TO SEEK
CIVIL AND/OR CRIMINAL PROSECUTION AND DAMAGES (INCLUDING ATTORNEYS’ FEES) FROM
OR AGAINST ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW.
The
invalidity or unenforceability of any provision of these Official Rules will
not affect the validity or enforceability of any other provision. In the event that any provision of the Official Rules is
determined to be invalid or otherwise unenforceable or illegal, the other
provisions will remain in effect and will be construed in accordance with their
terms as if the invalid or illegal provision were not contained herein.
Sponsor's failure to enforce any term of these Official Rules will not
constitute a waiver of that provision. Headings are solely for convenience of
reference and will not be deemed to affect in any manner the meaning or intent
of the Official Rules or any provision hereof.
By participating, the entrant agrees to release, indemnify,
defend, and hold harmless Sponsor and each of its respective officers,
directors, members, managers, employees, representatives, agents, successors
and assigns as well as the Social Media Group
(collectively, the “Released Parties”) from and against any and all claims,
expenses, and liability of any kind resulting or arising from the Giveaway
(including reasonable attorneys’ fees), including, but not limited to,
negligence and damages of any kind to persons and property, invasion of privacy
(under appropriation, intrusion, public disclosure of private facts, false
light in the public eye or any other legal theory), defamation, slander, libel,
violation of right of publicity, infringement of trademark, copyright, or other
intellectual property rights, property damage, or death or personal injury
arising out of or relating to their entry, creation of an entry or submission
of an entry, participation in the Giveaway, acceptance, use, or misuse of a
prize, or the broadcast, exploitation, or use of an entry.
To the maximum extent permitted by law, the Released Parties
are not responsible for: (i) any incorrect or
inaccurate information, whether caused by entrants, technical errors, or by any
of the equipment or programming associated with or utilized in the Giveaway;
(ii) technical failures of any kind, including, without limitation,
malfunctions, interruptions, or disconnections of the equipment or software
associated with or utilized in the Giveaway; (iii) unauthorized human and/or
mechanical intervention in any part of the entry process or the Giveaway; (iv)
technical or human error which may occur in the administration of the Giveaway
or the processing of entries; or (v) any injury or damage to persons or
property including, without limitation, death, bodily injury, pain and
suffering, emotional distress or loss of data which may be caused, directly or
indirectly, in whole or in part, from entrant’s participation in the Giveaway
or receipt, use or misuse of any prize. If for any reason an entrant’s entry is
confirmed to have been erroneously deleted, lost, or otherwise destroyed or
corrupted, the entrant’s sole remedy is to submit another entry during the
Giveaway Period through a method set forth in these Official Rules. Under no
circumstances will the entrant be permitted to obtain awards for, and the
entrant hereby waives all rights to claim punitive, incidental and
consequential damages and any other damages, other than for actual
out-of-pocket expenses, and any and all rights to have
damages multiplied or otherwise increased.
Some jurisdictions do not allow the limitations or exclusion of
liability for punitive, incidental or consequential damages, in which case the
liability of the Released Parties will be limited to the maximum extent
permitted by law. By participating, the
entrant acknowledges and agrees that remedies for any breach of these Official
Rules by the Released Parties are limited to an action at law for money
damages, if any, and an entrant shall not be entitled to equitable relief.
All entry information
becomes the sole and exclusive property of Sponsor. Entrant
agrees to Sponsor’s collection, use and disclosure of their personal information
(including information derived from a postcard or letter entry) in accordance
with its privacy policy, available at www.pokergo.com/privacy-policy.
Please refer to each Social Media Group company’s respective privacy policy for
important information regarding their collection, use and disclosure of
personal information.

A winners’ list
reflecting the Ethereum wallets that received a prize during the Giveaway (the
“Giveaway Winners’ List”) will be available upon request by sending a
self-addressed stamped envelope to: PokerGO, 3993 Howard Hughes Pkwy., Suite 450, Las Vegas, Nevada
89169, Attn: PokerGO
Genesis NFT: Play with The Masters Giveaway Winners’ List. The Winners’ List will be available for at
least three (3) months after the end of the Giveaway.
